1. Agreement

By booking photography services with Shawn N Productions, the Client agrees to these Terms & Conditions.

2. Cancellations & Rescheduling

Client Cancellation

  • If the Client cancels within 72 hours of the scheduled session or event, a $75 fee will be charged to the client. (This Fee May Only Be Waived At The Discretion of the Photographer

Rescheduling

  • Rescheduled sessions must occur within 90 days of the original session date.

Photographer Cancellation

If the Photographer is unable to perform services due to illness, emergency, or circumstances beyond their control, the Photographer will make reasonable efforts to find a replacement photographer or provide a full refund of payments received.

3. Session Conduct

The Client is responsible for obtaining any necessary permissions, permits, or approvals for photography locations.

The Photographer reserves the right to terminate coverage without refund if faced with unsafe, threatening, illegal, or abusive conditions.

4. Artistic Style

The Client acknowledges familiarity with the Photographer's portfolio and agrees that images will be delivered in the Photographer's artistic style and professional judgment.

Specific poses, compositions, or moments requested by the Client will be attempted but are not guaranteed.

5. Image Delivery

  • Edited images will be delivered via online gallery, digital download, or other agreed method.

  • Delivery timelines are estimates and may vary based on workload, season, and project complexity.

  • Raw, unedited and unused images are not included unless agreed upon with photographer .

6. Copyright & Usage

All photographs remain the intellectual property and copyrighted work of the Photographer.

The Client receives a non-exclusive personal-use license to:

  • Download and share delivered images.

  • Print images for personal use.

  • Post images on personal social media accounts.

The Client may not:

  • Sell images.

  • Alter images significantly without permission.

  • Submit images for commercial use without written authorization.

Commercial usage rights must be purchased separately unless included in the agreement.

7. Photographer Portfolio Rights

The Photographer may use photographs from the session for portfolio, website, social media, marketing, competition, and promotional purposes unless the Client requests privacy in writing before the session.

8. Limitation of Liability

In the unlikely event of equipment failure, loss of images, acts of nature, illness, or circumstances beyond the Photographer's control, liability shall be limited to the amount paid by the Client.

The Photographer is not responsible for missed images due to:

  • Late arrivals.

  • Uncooperative subjects.

  • Venue restrictions.

  • Weather conditions.

  • Interference by guests or third parties.

9. Image Storage

The Photographer will maintain delivered images for up to 90 days after delivery. Long-term storage is not guaranteed. Clients are responsible for backing up their files upon receipt.

10. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including natural disasters, severe weather, government restrictions, pandemics, power outages, or other emergencies.

11. Acceptance

By signing a service agreement, paying a retainer, or otherwise booking services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
